Liability In Stanton DUI Car Accidents
Drunk driving is one of the main causes of car accidents resulting in bodily injury or death. According to the Centers for Disease Control, “Every day, 29 people in the United States die in motor vehicle crashes that involve an alcohol-impaired driver. This is one death every 50 minutes. The annual cost of alcohol-related crashes totals more than $44 billion.” Many people drive drunk dozens of times before they eventually cause an accident or get arrested. Even small amounts of alcohol can dramatically reduce a person’s ability to drive safely in the following ways.
- A blood alcohol content (BAC) of 0.02 can result in a decline of visual functions.
- A blood alcohol content (BAC) of 0.02 can result in some loss of judgement.
- A blood alcohol content (BAC) of 0.02 can result in a person not being able to stay within their lane.
It is illegal to operate a motor vehicle with a BAC of 0.08% or higher. Pursuant to California Vehicle Code 21801, the driver of a vehicle intending to turn to the left or to complete a U-turn upon a roadway must first yield the right of way to all traffic close enough so as to pose a hazard. Any driver that makes an abrupt U-turn in front of a motorcyclist could be held at fault through a civil claim. There are a number of steps that should be taken after any motorcycle accident.
- Photos of the accident site should be taken.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- A thorough, independent investigation should be conducted.
If the driver of a pickup truck was working at the time of a collision, their employer could also be held at fault. The family of the victim can pursue a civil claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
