Liability For Tustin High School Stabbings

School violence is much more common than many people realize. According to the National Center for Education Statistic, “During the 2019–20 school year, 77 percent of public schools recorded that one or more incidents of crime had taken place, amounting to 1.4 million incidents. This translates to a rate of 29 incidents per 1,000 students enrolled in 2019–20. Not all recorded incidents of crime were reported to sworn law enforcement.” There are a number of common contributing factors to school violence.

  • Mental Health Issues
  • Bullying
  • Poverty
  • Harsh or violent parenting

Schools have a legal obligation to take reasonable steps to prevent students from being the victims of violent crime on school property. Consider, for example, Taylor v. Oakland Scavenger Co., 17 Cal. 2d 594 [110 P.2d 1044]. The court held that it is the responsibility of school authorities to properly supervise school children at all times and to enforce all rules and regulations necessary for their protection. When school officials fail to supervise children who are then attacked, this could form the basis of a negligence claim. There are many steps that should be taken when a high school student is attacked on campus.

  • Surveillance footage should be sought.
  • All school records related to the assault should be examined.
  • Medical records should be preserved.
  • A thorough investigation should be conducted.
  • A personal injury attorney should be consulted.

School assaults can be one of the most harmful things that students can experience. It can harm the student both physically and psychologically. Assaults also are extremely disruptive to a student’s ability to learn and feel safe while doing so. Any student that is injured in an attack at school may have legal recourse through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your rights are.
