Irvine Chiropractor Lincoln Carillo Arrested For Allegedly Molesting Female Patients At Twins Chiropractic
IRVINE, CALIFORNIA (July 24, 2022) – An Irvine chiropractor identified as Lincoln Carillo has been arrested and is facing 24-years in jail for allegedly sexually assaulting female patients.
Orange County prosecutors are saying that the assaults took place between January and August of 2021. Lincoln Esguerra Carillo is charged with 23 counts of sexual assault related to 7 of his female patients, according to the Los Angeles Times.
The chiropractor was arrested in Virginia last week and was in the process of opening another chiropractic business. Police said the first victim to come forward sought relief for neck pain at Twins Chiropractic.
Authorities have been able to identify a total of seven victims thus far and expect more to come forward. The public information officer for the Orange County District Attorney’s Office said that Lincoln Carillo was making women believe that his conduct was part of their medical treatment.
To that end, the chiropractor is also facing four counts of sexual battery by fraudulent representation of a professional purpose. Lincoln Carillo is currently being held on a $1 million bond and is expected to appear before a judge in the coming days.
Liability For Sexual Assaults By Medical Professionals
Sexual assaults by medical professionals are unfortunately far more common than many people realize. According to a study in the Society of General Internal Medicine, “the U.S. National Practitioner Data Bank (NPDB) showed that from January 2003 through September 2013, 862 physicians had state licensing disciplinary actions because of sexual misconduct, totaling 974 such actions.” There are a number of steps that can be taken to help reduce the prevalence of sexual assaults in the medical setting.
- All medical staff should undergo a thorough background check.
- Medical staff should be properly monitored and supervised.
- Any reports of sexual misconduct should be thoroughly investigated.
- Medical staff should go through Sexual Violence and Sexual Harassment Prevention Training.
Doctors that commit sexual assault can typically be held accountable through criminal claims. Their employers could also potentially be held liable through a civil claim. A doctor’s employer may have engaged in the negligent hiring or supervision of the assailant. By showing that a doctor’s employer created a particular hazard or risk to patients, it is possible for liability to be extended to them. There are several elements that must be demonstrated in a negligent hiring claim against a doctor.
- The doctor was unfit for their job.
- The doctor’s employer should have known that they posed a risk to their patients.
- The unfit doctor harmed a patient.
- The employer’s negligent hiring, supervision or training was a substantial factor in causing a patient’s harm.
Sexual assault is no small matter. Survivors are statistically more likely to experience a wide range of negative health outcomes including PTSD. Any patient that is sexually assaulted by a chiropractor may be able to seek some measure of justice through a civil claim. Damages can help cover lost wages, medical bills and pain and suffering. An Orange County sexual abuse attorney can examine all of the unique facts of your case and let you know if you have a valid claim that can be pursued.
