Liability For Los Angeles Police Pursuit Accidents

Police pursuits are incredibly dangerous and are responsible for many fatal collisions every year. According to one study published in the Injury Prevention Journal, “There were 2654 fatal crashes involving 3965 vehicles and 3146 fatalities during the nine year study period. Of these, 1088 were to people not in the fleeing vehicle. These crashes often occurred at high speed, in the night, on local roads.” In general, police pursuits should be a measure of last resort. There are a number of alternatives to high speed pursuits.

  • Officers can use GPS tracking technology to locate suspects.
  • Officers can chose not to pursue suspects involved in minor offenses.
  • Officers can immobilize a suspects vehicle with a device known as “The Grappler.”

Pursuant to California Vehicle Code §17004.7(b)(1), police departments are required to develop a written set of guidelines for vehicle pursuits. Officers must also receive regular and periodic training on an annual basis regarding police pursuit policies. When a police department fails to promulgate its police policies to officers, this could form the basis of a negligence claim. Victims of police pursuit accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

In far too many situations, police officers will engage in pursuits when they are not necessary. In many more instances, police officers will fail to call off pursuits when they become needlessly dangerous. The family of any person that is killed in a police pursuit may have legal recourse through a wrongful death claim. A wrongful death attorney can examine all of the unique facts of your case free of cost and let you know what your legal options are.
