Liability For National City Pedestrian Accidents

Thousands of people are killed or seriously injured every year in pedestrian accidents. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” The vast majority of pedestrian accidents are totally preventable. There are a number of steps that drivers should take to avoid hitting pedestrians.

  • Drivers should slow down when entering school zones.
  • Drivers should abstain from alcohol and other intoxicating substances.
  • Drivers should continuously scan the road ahead of them for hazards.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of any vehicle shall yield the right of way crossing the road within any lawfully marked crosswalk. If a driver fails to reduce their speed and hits a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries including.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, drivers will often fight extremely hard to deny liability for any accident. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
