Liability In Santa Clarita Head-On Collisions

Car accidents remain one of the leading causes of serious injury and death in the United States. According to the NHTSA, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2020, speeding was a contributing factor in 29% of all traffic fatalities.” There are a number of factors that could potentially contribute to a head-on collision.

  • Driver fatigue
  • Distracted driving
  • Driver intoxication
  • Inclement weather

All drivers have a legal obligation to exercise due care in order to avoid collisions. Pursuant to California Vehicle Code 21460, no person shall cross over a double solid yellow line except under a very limited set of circumstances. There is a rebuttable presumption of negligence on the part of any driver that crosses into opposing lanes of traffic prior to a crash. Victims of head-on collisions tend to suffer very serious and costly injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The family of any person killed due to the negligence of another driver may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, drivers will often fight extremely hard to deny liability for any collision. This is why it is so important that all evidence is preserved after a crash.
