Liability In Los Angeles Pedestrian Accidents
Los Angeles has one of the highest instances of pedestrian accidents across California. According to LAist, “In 2019, 134 people were killed by drivers while walking in Los Angeles. That’s about one death every two-and-a-half days. In fact, pedestrian deaths increased from 87 in 2014 — or nearly 55% over 5 years. Hundreds more pedestrians are injured by drivers each year.” There are a number of steps that drivers should take in order to avoid hitting pedestrians.
- Drivers should slow down in areas with heavy pedestrian traffic.
- Drivers should always check their blind spots before making turns.
- Drivers should avoid alcohol and other intoxicating substances.
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of any vehicle shall yield the right of way to a pedestrian crossing the roadway in a lawfully marked crosswalk. Any pedestrian that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering.
