Liability In Wasco Bicycle Accidents
Bicyclists are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the Centers for Disease Control, “Bicycle trips make up only 1% of all trips in the United States. However, bicyclists account for over 2% of people who die in a crash involving a motor vehicle on our nation’s roads.” There are a number of factors that could contribute to any car accident.
- Speeding
- Distracted driving
- Inclement weather
- Driver fatigue
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. A large number of bicycle collisions are due to speeding. Pursuant to California Vehicle Code 22350, no person shall drive a motor vehicle at a speed greater than what would be safe given the prevailing conditions of the roadway. If the driver of truck was working at the time of a collision, their employer could face liability for the crash as well. There are a number of steps that should be taken after any car accident.
- Photos of the accident site should be taken.
- Surveillance footage should be sought.
- Eye witnesses should be interviewed.
- A thorough, independent investigation should be conducted.
The family of any person killed in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. In order to win any civil claim, plaintiffs will have to demonstrate negligence. This is why it is so crucial that all evidence is properly preserved after a crash.
