Liability For Los Angeles County Pedestrian Accidents

Los Angeles County has one of the highest instances of pedestrian collisions across California. According to the LAist, “In 2019, 134 people were killed by drivers while walking in Los Angeles. That’s about one death every two-and-a-half days. In fact, pedestrian deaths increased from 87 in 2014 — or nearly 55% over 5 years. Hundreds more pedestrians are injured by drivers each year.” There are a number of factors that could contribute to a hit-and-run collision.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver intoxication

All drivers have a legal obligation to exercise due care to avoid pedestrians. It is illegal for any driver to flee the scene of a collision that results in bodily injury or death. Pursuant to California Vehicle Code 20001, the driver of any vehicle involved in an accident resulting in bodily injury or death must remain at the scene and exchange insurance information with the affected parties. Drivers that flee the scene of a collision may face criminal and civil liability for their actions. There are a number of steps that should be taken after any hit-and-run collision.

  • Surveillance footage should be sought.
  • Fragments of the fleeing vehicle should be examined.
  • Eye witnesses should be interviewed.

Many accident victims may not realize the full extent of their injuries for several weeks or months after a collision. Any person that is injured in a pedestrian collision may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are.
