Liability for Oxnard Pedestrian Accidents
Far too many people are killed or seriously injured every year in pedestrian accidents. According to the CDC, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” Elderly pedestrians are particularly at risk of being involved in collisions. There are a number of steps that drivers should take to avoid hitting pedestrians.
- Drivers should check their blind spots before turning.
- Drivers should slow down in areas with heavy pedestrian traffic.
- Drivers should continuously scan the road ahead of them and avoid distractions.
All drivers have a legal obligation to exercise due care to avoid hitting pedestrians. This is true even if a pedestrian was outside of a marked crosswalk. If a driver fails to reduce their speed or take other measures to avoid hitting a pedestrian, this could form the basis of a negligence claim. The company that the operator of a van worked for could also potentially bear some liability for a collision. Many vans are used for commercial purposes. There are a number of steps that should be taken after any pedestrian accident.
- The employment status of the driver of any van involved in a collision should be determined.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- A thorough investigation should be conducted.
The family of any person that died due to the negligence of another driver may have recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. Sadly, though, many drivers that hit pedestrians will do everything that they can to deny liability for a collision. This is why it is so important that all evidence is properly preserved after any crash.
