Paramedics were called to the scene of the collision in order to help the victim. He was flown to a trauma center with serious injuries.

A full investigation into the collision remains ongoing at this time.

Liability In Malibu Pedestrian Accidents

Los Angeles County has some of the highest instances of pedestrian accidents in all of California. According to the Centers For Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” There are a number of steps that drivers should take in order to avoid hitting pedestrians.

  • Drivers should check their blind spots before turns.
  • Drivers should scan the road and remain vigilant at all times.
  • Drivers should reduce their speed when pedestrians are nearby.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. This is true even if a pedestrian is outside of a lawfully marked crosswalk. If a driver fails to reduce their speed and hits a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, insurance companies will do everything in their power to avoid helping accident victims. This is why it is so crucial that evidence is properly preserved after any collision.
