Liability In Pico Rivera Car Accidents

Car accidents remain one of the leading causes of serious injury and death in the United States. According to the Centers for Disease Control, “more than 32,000 people are killed and 2 million are injured each year from motor vehicle crashes. In 2013, the US crash death rate was more than twice the average of other high-income countries.” There are a number of factors that could contribute to a car accident.

  • Speeding
  • Drunk driving
  • Inclement weather
  • Driver distraction
  • Driver fatigue

Around one third of all fatal collisions involve a driver that was speeding. According to California Vehicle Code 22350, no person shall drive a motor vehicle at a speed greater than what would be reasonable or safe given the prevailing conditions of the roadway. If a driver failed to reduce their speed to avoid a collision, this could form the basis of a negligence claim. There are a number of steps that should be taken after any car accident.

  • Surveillance footage should be sought.
  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • An investigation should be conducted.

The family of any person that is killed in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is very important that evidence is properly preserved after a collision.
