Liability In Lancaster Scooter Accidents
Motorized scooters have become increasingly popular with the rise of companies like Lime an Bird. According to the Consumer Product Safety Commission, “There were more than 190,000 emergency room (ED) visits due to all micromobility products from 2017 through 2020. ED visits had a steady 70% increase from 34,000 (2017), 44,000 (2018), 54,800 (2019) to 57,800 (2020).” There are a number of reasons that scooter riders are vulnerable in car accidents.
- They lack the protection of enclosed vehicles.
- They are more likely to be overlooked due to their small profile.
- Scooters tend to be more prone to serious malfunctions than enclosed vehicles.
All drivers have a legal obligation to exercise due care in order to avoid collisions. Many collisions are due to drivers that make unsafe turns. Pursuant to California Vehicle Code 21801, the driver of any vehicle intending to turn left must first yield the right of way to any vehicle close enough so as to pose a hazard. The family of any victim that died in a car accident may have legal recourse through a wrongful death claim.
