Liability For Fresno Pedestrian Accidents

Thousands of people are killed or seriously injured in pedestrian accidents every year. According to the CDC, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” The majority of pedestrian collisions involve some amount of driver error. There are a number of steps that drivers should take in order to avoid hitting pedestrians.

  • Drivers should slow down in areas with heavy pedestrian traffic.
  • Drivers should abstain from alcohol and other intoxicating substances.
  • Drivers should check their blind spots before making turns.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of any vehicle shall yield the right of way to a pedestrian crossing in a lawfully marked crosswalk. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is essential that all evidence is properly preserved after a collision.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough, independent investigation should be conducted.

Many accident victims may not realize the full extent of their injuries for several weeks or months after a collision. Even after the physical injuries of an accident have healed, it is common for survivors to suffer from long term psychological trauma. Any person that is injured in a car accident may have legal recourse through a bodily injury claim.
