Liability In Inyokern Car Accidents

Car accidents are one of the leading causes of serious injury and death in the United States. According to the IIHS, “There were 33,244 fatal motor vehicle crashes in the United States in 2019 in which 36,096 deaths occurred. This resulted in 11.0 deaths per 100,000 people and 1.11 deaths per 100 million miles traveled. The fatality rate per 100,000 people ranged from 3.3 in the District of Columbia to 25.4 in Wyoming.”  There are many factors that could contribute to collisions including:

  • Inclement weather such as rain or snow
  • Drivers that are under the influence of alcohol or drugs
  • Drivers that are traveling too fast for the prevailing conditions
  • Drivers that are distracted by their phones or GPS

The vast majority of car accidents are due to drivers that commit traffic infractions. When accidents occur on the freeway, they often involve one driver that rear-ends another vehicle. According to California Vehicle Code 21703, no person shall follow a motor vehicle more closely than would be reasonable or prudent given the prevailing conditions of the roadway. Rear-end collisions are among the most common types of accidents. They are also the most preventable. Any driver that rear-ends another vehicle is typically presumed to be at fault.

Depending on the facts of any case, liability for a car accident may extend beyond any driver. For example, if the at-fault driver was working at the time of a collision, their employer could also be held at fault. Generally speaking, companies are liable for the negligent actions of their employees – insofar as those employees were working within the course and scope of their job duties. An at fault driver may have been delivering cargo or animals for a company.

Determining liability for any collision can be very difficult. It is common for multiple parties to bear at least some responsibility for an accident. Many people often assume that if they are partially at fault for a collision, they will not have legal recourse. But this is not the case. California is a pure comparative fault state. Even if a driver is partially liable for a collision, they will typically have legal recourse. There are many steps that should be taken after a car accident.

  • Surveillance footage of the accident should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • Photos of the accident site should be taken.

The family of any victim that died in a collision may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the unexpected expenses that come with the sudden loss of a loved one. It is important that evidence is properly preserved after any collision. Evidence is what will ultimately be used to determine liability for an accident. A wrongful death attorney can examine the unique facts of your case and let you know what your legal options are.
