Liability In San Fernando Valley Car Accidents

Speeding is one of the main causes of car accidents in the United States. According to the NHTSA, “Twenty-eight percent of fatal crashes, 13 percent of injury crashes, and 10 percent of property-damage-only crashes in 2020 were speeding-related.” There are a number of other factors that could contribute to a car accident.

  • Distracted driving
  • Inclement weather
  • Poor road conditions
  • Driver intoxication

It is illegal to operate any motor vehicle in excess of the speed limit. Pursuant to California Vehicle Code 22350, no person shall drive a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. If a driver fails to slow down to avoid a collision, this could form the basis of a negligence claim. Victims of car accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The family of any person that is killed in a car accident may be able to seek some measure of justice through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is extremely important that all evidence is properly preserved after any crash. Evidence is what will ultimately be necessary to demonstrate negligence.
