Liability For Bakersfield Car Accidents
Thousands of bicyclists are killed or seriously injured every year in car accidents. Children and elderly adults tend to be at the greatest accident risk. According to the Centers for Disease Control, “Adolescents, teens, and young adults have the highest rates of bicycle-related injuries treated in emergency departments (EDs). People ages 10-24 account for nearly one-third of all bicycle-related injuries seen in US EDs.” There are a number of common causes of bicycle accidents.
- Driver fatigue
- Driver intoxication
- Speeding
- Poor road conditions
Bicyclists have the same rights and responsibilities as people who are driving cars. Many bicycle collisions are due to drivers that are making dangerous left turns. Pursuant to California Vehicle Code 21801, the driver of any vehicle intending to turn left must yield the right of way to any driver close enough so as to pose a hazard. If a driver fails to slow down and hits a bicyclist, this could form the basis of a negligence claim. There are a number of steps that should be taken after any bicycle accident.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- A thorough, independent investigation should be conducted.
When a driver is negligent and hits a bicyclist they can be held at fault through a civil claim. The family of any person killed in a bicycle accident can seek some measure of justice through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is important that all evidence is properly preserved after any collision.
