Liability For Lancaster Car Accidents

Far too many pedestrians are killed or seriously injured every year. According to the NHTSA, “pedestrian injuries and fatalities remain high. In 2020, 6,516 pedestrians were killed and an estimated 55,000 pedestrians were injured nationwide.” The vast majority of pedestrian accidents are preventable and involve some amount of driver error. Pedestrian accidents are more likely to occur in a number of different settings.

  • Pedestrian collisions are more likely to occur in the early morning hours and late evening when visibility is reduced.
  • Pedestrian collisions are more likely to occur immediately after it rains when the roads are most slick.
  • Pedestrian collisions are more likely to occur in urban areas and at intersections.

All drivers have a legal obligation to exercise due care in order to avoid hitting any pedestrian in the roadway. Drivers must slow down to avoid pedestrians and take any other action necessary to avoid collisions. If the driver of a van was working during a crash, the company that they were working for could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. There are a number of steps that should be taken after any collision.

  • Photos of the accident site should be taken.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough, independent investigation should be conducted.

The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that can come with a sudden death of a loved one. Unfortunately, drivers will often fight hard to deny liability for any collision. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
