Geovany Rojas, Julian Hernandez Killed In Arroyo Grande Car Accident On Highway 1

ARROYO GRANDE, CALIFORNIA (July 10, 2022) – Two people from Santa Maria identified as Geovany Rojas and Julian Hernandez were killed in an Arroyo Grande car accident on Highway 1.

San Luis Obispo officials are saying that the accident took place around 4:45 a.m. on Wednesday. Geovany Rojas and Julian Hernandez were traveling down the road in a Honda Civic when the driver of a pickup truck made a left turn directly in front of them.

The driver of the Honda was not able to avoid the collision and collided directly with the pickup truck. Firefighters and paramedics were called to the scene of the collision in order to help both of the victims.

Sadly, Geovany Rojas and Julian Hernandez were both beyond medical aid and died due to the severity of their injuries. A full investigation remains ongoing at this time.

Liability In Arroyo Grande Car Accidents

Car accidents remain one of the leading causes of serious injury and death in the United States. According to the IIHS, “There were 35,766 fatal motor vehicle crashes in the United States in 2020 in which 38,824 deaths occurred. This resulted in 11.7 deaths per 100,000 people and 1.34 deaths per 100 million miles traveled.” There are a number of steps that drivers should take in order to avoid potentially causing accidents.

  • All drivers must abstain from alcohol and drugs.
  • Drivers must check their blind spots before making turns.
  • Drivers should be well rested before heading out on the road.

Drivers have a legal responsibility to exercise due care in order to avoid causing accidents. Many accidents are due to drivers that make unsafe left turns. Pursuant to California Vehicle Code 21801, the driver of any vehicle intending to turn to the left shall yield the right of way to any vehicle traveling from the opposite direction that is close enough so as to pose a hazard. If a driver makes an abrupt left turn in front of another vehicle, they will typically be held at fault in the event of a collision.

Many pickup trucks are used for commercial purposes including landscaping and construction. If the driver of a pickup truck was working at the time of a collision, their employer could be held at fault. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a pickup truck driver may have been transporting goods when they crashed. There are a number of steps that should be taken after any car accident.

  • Photos of the accident site should be taken.
  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • A thorough, independent investigation should be conducted.

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages can help cover many of the unexpected expenses that can come with the sudden loss of a love one. Sadly, though, people will often fight hard to deny responsibility for any accident. That is why it is so important that evidence is properly preserved.
