Liability In California Car Accidents
Car accidents are one of the leading causes of serious injury and death in the United States. According to data from the Centers for Disease Control, over 32,000 people are killed in car accidents in the United States every year and over 2,000,000 are injured. Nearly one in three fatal collisions in the United States involve a driver that was intoxicated. There are many other factors that could potentially contribute to a car accident including:
- Speeding
- Driver distraction
- Inclement weather
- Slowed traffic
- Drug use
Rear-end collisions are among the most common type of vehicle accidents that occur. They are also the most preventable. They typically happen when drivers are speeding or following the lead vehicle too closely. According to California Vehicle Code 22350, no person shall drive a vehicle at a speed greater than what would be safe and reasonable given the prevailing conditions of the roadway. There is a rebuttable presumption of negligence on the part of any driver that rear-ends another vehicle.
Many pickup trucks are used for commercial purposes such as construction or landscaping. If the driver that rear-ended another vehicle was working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, companies are liable for the negligent actions of their employees – insofar as those employees were working within the course and scope of their job duties. Victims of car accidents tend to suffer very serious and costly injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Even after the physical injuries of an accident have healed, many victims are left with long-term psychological trauma. Any person that is injured in a car accident may be able to seek damages through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A car accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
