Motorcycles are less crashworthy than closed vehicles and are also more likely to be overlooked. According to data from the National Highway Traffic Safety Administration, 5,014 motorcyclists died in 2019 alone. Per vehicle miles traveled, motorcyclists were nearly 29 times more likely to die in a crash than those in passenger vehicles. There are a large number of factors that could potentially contribute to a motorcycle accident.

  • Inclement weather
  • Driver fatigue
  • Driver distraction
  • Speeding
  • Dangerous turns

Semi-trucks are especially dangerous to people riding motorcycles. Truck drivers often fail to see motorcycles because of their large blind spots. Many collisions are due to truck drivers that make unsafe lane changes into the path of motorcyclists. Pursuant to California Vehicle Code 22107, no driver shall turn a vehicle left or right upon a roadway until such a movement can be done with reasonable safety. Truck drivers are trained to check their blind spots before making lane changes, but this doesn’t always happen.

It’s very important that evidence is properly preserved and protected after any accident. Even in the absence of footage of an accident, damage to both vehicles as well as injuries can help paint a picture of what happened. Many trucks are equipped with event data recorders (EDRs). These devices can give a great deal of insight into what a truck driver was doing prior to a crash. This includes information about the speed of the truck, pre-crash vehicle dynamics and driver inputs.

In certain situations, liability could extend to the company in charge of vetting a truck driver’s qualifications. Truck companies must ensure that their drivers have a clean driving record and the correct commercial license to operate their rig. Sadly, though, this doesn’t always take place. Some truck companies have even hired driver’s that were unlicensed. There are a number of steps that should be taken after any semi-truck accident.

  • Surveillance footage should be sought.
  • The truck driver’s license should be examined.
  • Eye witnesses should be interviewed.
  • All vehicles involved in a crash should be examined.

The family of any victim that died in a truck accident may have legal recourse through California Civil Code 377.60. Damages in a civil claim can help cover many of the unexpected expenses that can come with the sudden loss of a love one. Potential beneficiaries in a civil claim will typically include a victim’s next of kin such as their spouse, siblings or parents. A truck accident attorney can examine all of the unique facts of your case  and let you know what your legal options are.
