Liability For Rosemead Semi-Truck Accidents
A fully loaded semi-truck can weigh 80,000 lbs and is much more difficult to control than passenger vehicles. According to the Federal Motor Carrier Safety Administration, “Elements that influence the occurrence of a crash may take place hours, days, or months before the crash. They include driver training and experience, vehicle design and manufacture, highway condition and traffic signaling, and weather conditions.” There were three critical events in particular that account for the majority of semi-truck accidents.
- The truck driver went into another lane of traffic.
- The truck driver lost control due to speed, cargo shift, vehicle systems failure or other reasons.
- The truck driver collided with another vehicle in their own lane of traffic.
Semi-truck drivers will need to get a commercial license and are held to a high standard in terms of safety. They must get specialized training and become very familiar with how their rig operates. Semi-trucks have large blind spots that can obscure the presence of smaller vehicles. Many truck accidents are due to truck drivers that make dangerous lane changes. Pursuant to California Vehicle Code 22107, no person shall drive a vehicle right or left upon a roadway unless such a movement can be made with reasonable safety.
If a semi-truck driver was working at the time of a collision, the company that they were working for could be held at fault. In general, employers are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. However, many truck companies will try to avoid liability for collisions by hiring their drivers as “independent contractors.” Victims of semi-truck accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
It can be difficult to know what to do after any collision. But it is important for accident victims to remember that they do have rights. The family of any person killed in a semi-truck accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the facts of your case free of cost and get to the bottom of what caused a collision.
