Liability For Los Angeles International Airport Carbon Monoxide Accidents
Carbon monoxide is an odorless and colorless gas. It is most commonly created from the burning of fossil fuels. According to the Centers for Disease Control, “Approximately 50,000 people in the U.S. visit the emergency department each year due to accidental CO poisoning.” Carbon monoxide accidents tend to spike during the winter months every year. There are a number of symptoms that can indicate carbon monoxide poisoning.
- Headache
- Weakness
- Dizziness
- Shortness of breath
- Confusion
- Loss of consciousness
When a worker is injured on the job, they will typically have recourse through worker’s compensation. Worker’s compensation is based on a no-fault insurance scheme. In other words, there is no need for an injured worker to demonstrate negligence to receive benefits if they were injured on the job. An injured worker or their family should let their doctor know as early as possible that they were injured on the job.
Depending on the facts of any case, an injured worker may also be able to seek damages through a third party liability claim. A third party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident. For example, a property owner could be liable for a carbon monoxide accident if their premises were not maintained in a reasonably safe condition. There are a number of common sources of carbon monoxide leaks.
- Clothes dryers
- Water heaters
- Furnaces
- Fireplaces
- Gas stoves
Any person that is injured in a carbon monoxide poisoning accident may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. Many accident victims may not realize the full extent of their injuries for several weeks or months after an accident. Unfortunately, property owners will often fight extremely hard to deny liability for any accident. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
