Liability In San Dimas Truck Accidents

Thousands of people are killed or seriously injured in truck  accidents every year. A fully loaded semi-truck can weigh as much as 80,000 lbs. A truck of this size traveling at freeway speeds can take the length of two football fields to come to a stop. Semi-trucks also tend to have very large blind spots that can obscure the presence of smaller vehicles. There are a number of steps that truck drivers should take in order to prevent collisions.

  • Truck drivers should always check their blind spots before turning or changing lanes.
  • Truck drivers should always be well rested before the start of their shift.
  • Truck drivers should ideally plan their routes ahead of time.

Truck drivers must get a commercial driver’s license (CDL) and are held to a high standard in terms of safety. Serious traffic infractions can jeopardize a truck driver’s ability to maintain their CDL. Any person that drives a commercial truck must also follow all rules and regulations set forth in Title 49 of the Code of Federal Regulations. Among other things, truck drivers cannot drive more than 11 hours in a day over a 14 hour work window.

The vast majority of truck accidents are preventable and involve some amount of human error. Many collisions are due to truck drivers than make dangerous lane changes. Pursuant to California Vehicle Code 22107, no person shall turn a vehicle from a direct course or move left or right upon a roadway until such movement can be made with reasonable safety. A driver intending to change lanes must also use an appropriate signal. If a truck driver committed a traffic infraction and caused an accident, they could be held at fault through a civil claim.

Depending on the facts of any case, liability for a truck accident could extend beyond a truck driver. If a truck driver was working at the time of a collision, the company that they were working for could potentially be held at fault. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. However, many truck companies try to evade liability for crashes by hiring truck drivers as “independent contractors.” There are a number of steps that should be taken after any truck accident.

  • Photos of the accident site should be taken.
  • Surveillance footage should be sought.
  • A forensic analysis of the crash may need to be conducted.
  • A thorough, independent investigation should be performed.

When a truck driver is involved in a fatal collision, they can be held at fault through a civil claim. The family of any victim that died in a semi-truck accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that can come with the sudden and tragic loss of a loved one. Unfortunately, many truck companies will do everything in their power to deny liability for any collision. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
