Liability In Ventura Industrial Accidents

The manufacturing industry can be particularly dangerous for workers. According to the Centers For Disease Control, “The manufacturing industries had 836,700 injuries [in 2004], representing nearly 20% of the private industry total. Manufacturing had an injury and illness a rate of 6.6 cases per 100 equivalent full-time workers, down from 6.8 a year earlier.” There are a number of steps that manufacturing companies should take in order to keep workers safe.

  • Workplaces should be kept in a relatively safe condition.
  • All machinery should be regularly inspected and well maintained.
  • Workers should be trained in the proper lock-out/tag-out procedures.

The family of any worker that is killed in an industrial accident may be able to seek aid through a worker’s compensation claim. Worker’s compensation is based on a no-fault insurance scheme in California. There is no need for an injured worker or their family to demonstrate negligence. Depending on the facts of any case, the family of a deceased worker may also be able to pursue a third-party liability claim. A third-party liability claim may be possible when an entity separate from a worker’s employer contributed to an accident.

There could be numerous sources of third-party liability for any industrial accident. For example, the manufacturer of a piece of heavy machinery may have created a device that lacked adequate safety guards. Most pieces of heavy machinery will need to have some type of safety guards to prevent workers from becoming entrapped. But this is not always the case. There are a number of steps that should be taken after any industrial accident.

  • Surveillance footage should be sought.
  • Eyewitnesses should be interviewed.
  • Maintenance records should be examined.
  • A thorough, independent investigation should be conducted.

The family of any victim that died in an industrial accident may have legal recourse through the California Code of Civil Procedure 377.60. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering. Potential beneficiaries may include a victim’s spouse and children. Unfortunately, companies that manufacture heavy equipment will fight hard to deny liability if a worker is injured with their products. This is why it is so important that all evidence related to an industrial accident is properly preserved and protected.
