Liability In Fresno Semi-Truck Accidents

Thousands of people are killed or seriously injured with trucks every year in the United States. According to the FMCSA, “In 2019, 5,237 large trucks and buses were involved in fatal crashes, a 2-percent increase from 2018. From 2018 to 2019, large truck and bus fatalities per 100 million vehicle miles traveled by all motor vehicles declined from 0.162 to 0.161, 21 percent below the 21st-century peak of 0.205 in 2000.” The vast majority of truck accidents involve some amount of human error.

  • A truck driver may have been traveling too fast for the prevailing conditions.
  • A truck driver may have failed to scan the road for hazards.
  • A truck driver may have failed to reduce their speed to avoid a collision.

Semi-truck drivers will typically need to get a commercial license and are held to a high standard in terms of safety. Pursuant to California Vehicle Code 21950, the driver of any vehicle shall yield the right of way to any pedestrian within any marked or unmarked crosswalk  and shall reduce their speed as necessary to safeguard the safety of the pedestrian. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim.

The company that a truck driver worked for could potentially be held liable for a collision. Companies are typically liable for the wrongful actions of their employees . However, the employee must have been working within the course and scope of their job duties. For example, a truck driver may have been delivering packages when they were involved in a crash.

The company that packed a semi-truck could also be liable for a collision involving a pedestrian. All trucks have designated carrying limits. But these limits are not always obeyed.  If these limits are exceeded, it could increase the distance that it takes for the truck to come to a stop. This, in turn, could lead to a pedestrian collision. It is common for trucks to be loaded with extra goods so that the truck company can make more money. There are a number of steps that should be taken after any semi-truck accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • The truck’s event data recorder should be examined.
  • The truck driver’s logbook should be reviewed.

The family of any person killed in a truck accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that can come with the sudden loss of a loved one. In order to win any civil claim, plaintiffs will have to demonstrate negligence. A wrongful death attorney can examine the unique facts of your case free of cost and get to the bottom of what caused any accident.
