Liability In Las Vegas Truck Accidents
Far too many bicyclists have been killed or seriously injured in Las Vegas. As the city has continued to grow in population, the roads have not kept pace. This has put a greater number of cyclists and drivers into close proximity with one another. According to reporting from the New York Times, five people were killed on a rural stretch of highway near Las Vegas in January of 2022. Many of the victims were obeying all traffic laws and were hit by frustrated or distracted drivers. This has pushed bicycle safety advocates to call for changes. There are many steps that cities can take in order to prevent bicycle accidents.
- Cities should study roadways and intersections with a history of collisions.
- Cities should install traffic calming measures along roads with a history of speeding.
- Protected bicycle lanes can help prevent errant vehicles from hitting bicyclists.
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians and bicyclists. Pursuant to NRS 484B.600, no person shall operate a motor vehicle at a speed greater than what would be reasonable or safe given the prevailing conditions of the roadway. According to NRS 484B.270, the driver of a motor vehicle attempting to overtake a bicycle in the same direction shall exercise due care to avoid a collision. If there is more than one lane on the roadway, the driver should move to the lane to their immediate left. When there is only one lane of traffic, the driver must maintain at least three feet of separation from the bicyclist.
Pickup trucks are often used for commercial purposes such as landscaping or construction. If the driver of a pickup truck was working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, companies are liable for the negligent actions of their employees – insofar as those employees were working within the course and scope of their job duties. A company could also be liable for the negligent hiring, retention or supervision of their employees. There are a number of steps that should be taken after any bicycle accident.
- Surveillance footage of the accident should be sought.
- Eye witnesses should be interviewed.
- The purpose of a pickup truck driver’s trip should be determined.
- Photos of the accident site should be taken.
- A thorough, independent investigation should be conducted.
The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages can help cover many of the unexpected expenses that can come with the sudden loss of a loved one. Sadly, though, companies will often fight hard to deny liability for any accident. It is important that evidence is properly preserved after any collision. Evidence is what will ultimately be used to determine liability. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
