Liability For San Antonio Explosion Accidents

According to the U.S. Bureau of Labor Statistics (BLS), around 200 workers are killed and over 5,000 are injured in workplace explosion accidents every year. Workers in the construction industry are exposed to a number of potential explosive hazards. There are a number of combustible materials that construction workers typically deal with including combustible dusk, gas and flammable liquids. Construction companies should take many different precautions to prevent workplace explosions.

  • Only a qualified person should ever mix chemicals together on a worksite.
  • Equipment should always be properly maintained.
  • Areas with hazardous materials should be properly ventilated.

When a worker is injured or killed in Texas they or their family will typically have recourse through a worker’s compensation claim. Workers compensation is based on a no-fault insurance plan. Depending on the facts of any case, the family of a deceased worker may also have recourse through a third party liability claim. A third party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident.

The Occupational Safety and Health Administration (OSHA) has a number of safety requirements to help keep worksites safe. If a general contractor fails to maintain their premises in a reasonably safe condition, this could form the basis of a negligence claim. For example, combustible material may have been left near a heat source. There are a number of steps that should be taken after any explosion accident.

  • Eye witnesses should be interviewed.
  • Surveillance footage should be sought.
  • Safety records should be examined.

The family of any person that is killed in a job site explosion may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that can come with the sudden loss of a loved one. Sadly, though, property owners and general contractors will often fight extremely hard to deny liability for any accident. This is why it is so important that evidence is properly preserved after any accident.
