Liability For Fulshear Semi-Truck Accidents
Semi-trucks are very difficult to operate and their drivers are put under an enormous amount of pressure to work as much as possible. According to one report by the FMCSA, “The Large Truck Crash Causation Study (LTCCS) reported that 13 percent of commercial motor vehicle (CMV) drivers were considered to have been fatigued at the time of their crash.” There are a number of steps that truck drivers can take to limit driver fatigue.
- Truck drivers should ensure that they get enough sleep before getting behind the wheel.
- Truck drivers should maintain a healthy diet.
- Truck drivers should take periodic breaks as required by law.
- Truck drivers should avoid any medications that could induce drowsiness.
All truck drivers have a legal obligation to use care to avoid collisions. Pursuant to Texas Transportation Code § 544.007 (d), any driver approaching a red circular signal must stop and yield the right-of-way to cross traffic and only proceed when they have been given the appropriate signal. There is a rebuttable presumption of negligence on the part of any driver that goes through a red light and hits another vehicle. Victims of car accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Organ damage
- Burn injuries
If a semi-truck driver was working at the time of a collision, their employer could be held at fault. In general, companies are liable for the wrongful actions of their employees who were working within their job duties. The family of any person that died in a semi-truck accident may be able to seek some measure of justice through a wrongful death claim.
