HOUSTON, TEXAS (August 7, 2022) – A toddler identified as Nicolas Resendiz died after a cement truck fell from a Houston overpass onto his family’s SUV by Woodforest Boulevard and Beltway 8.
Harris County officials are saying that the accident took place around 2:30 p.m. on Friday. Nicolas Resendiz was in the back of his family’s SUV with his twin sister when a cement truck fell from an overpass and landed on the vehicle.
Good Samaritans were able to extricate three family members from the crumpled SUV. Firefighters and paramedics were called to the scene of the collision in order to help the victims.
Both children were strapped into car seats. Sadly, Nicolas Resendiz was beyond medical aid and pronounced dead at the scene. His twin sister was able to survive the crash.
Deputies believe that the driver of the concrete mixer truck tried to slow down prior to the crash. Slick road conditions may have contributed to the accident.

Liability In Houston Cement Truck Accidents
A fully loaded cement truck can weigh as much as 66,000 lbs. These vehicles can be extremely dangerous to smaller vehicles for numerous reasons. They are much more difficult to stop. They are also much more likely to tip over given how top-heavy they are. Cement truck drivers must approach turns very cautiously in order to be safe. There are a number of steps that truck companies can take in order to help prevent accidents.
- Cement truck drivers will typically need a commercial license.
- Cement truck drivers should be properly trained to handle their specific vehicles.
- Cement trucks should be periodically inspected and well-maintained.
All truck drivers have a legal obligation to exercise due care in order to avoid causing accidents. Pursuant to Texas Transportation Code Section 545.351(1), no person shall drive a motor vehicle at a speed greater than what would be reasonable or prudent given the prevailing conditions of the roadway. Driving the speed limit could very well be dangerous during periods of heavy traffic, inclement weather or reduced visibility.
If a cement truck driver was working at the time of a crash, their employer could also be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a cement truck driver may have been delivering cement to some construction project. There are a number of steps that should be taken after any cement truck accident.
- Surveillance footage of the accident site should be sought.
- Medical records should be preserved.
- Photos of the road where the accident took place should be taken.
- Eye witnesses should be interviewed.
When a cement truck driver is negligent, they can be held at fault through a civil claim. The family of any victim that died in a cement truck accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the unexpected expenses that can come with the sudden loss of a loved one. Sadly, though, truck companies will often fight extremely hard to deny liability for any collision. A wrongful death attorney can examine all of the unique facts of your case free of cost and let you know what your legal options are.
