Liability For Bryan Semi-Truck Accidents
Semi-trucks can weigh as much as 80,000 lbs and can be extremely dangerous. According to the FMCSA, “Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur.” There are a number of steps that truck drivers should take to avoid causing accidents.
- Truck drivers should be well rested before heading out onto the road.
- Truck drivers should take periodic breaks as required by law.
- Truck drivers should abstain from alcohol and drugs.
Any person that drives a commercial truck must follow all rules and regulations set forth in Title 49 of the Code of Federal Regulations. Among other things, truck drivers cannot drive more than 11 hours in a day over a 14 hour work window. Accidents are more likely to occur if truck drivers are pushed to complete their routes on unrealistic time schedules.
Pursuant to Texas Transportation Code Section 545.351, no person shall operate a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. If a truck driver failed to slow down to avoid causing an accident, this could form the basis of a negligence claim. There are a number of steps that should be taken after any semi-truck accident.
- Eye witnesses should be interviewed.
- Surveillance footage should be sought.
- The truck driver’s work logs should be examined.
- A thorough investigation should be conducted.
The family of any person that is killed due to the negligent actions of a truck driver may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that often come with the sudden loss of a loved one. It is extremely important that all evidence is properly accounted for after any collision. Evidence is what will be necessary to determine liability for a crash.
