Liability For Harris County Car Accidents
Thousands of pedestrians are killed or seriously injured every year in car accidents. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes. One in six people who died in crashes in 2020 were pedestrians.” There are a number of factors that could potentially contribute to a pedestrian accident.
- Speeding
- Distracted driving
- Poor road conditions
- Inclement weather
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians in the roadway. They must yield the right of way to pedestrians crossing the roadway. Even if a pedestrian is not crossing the roadway, drivers must slow down to avoid colliding with pedestrians. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. There are many steps that should be taken after any pedestrian collision.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A thorough, independent investigation should be conducted.
The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral expenses. Sadly, though, it is common for drivers to fight to deny liability for any collision. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
