Angelina County officials are saying that the collision took place in early January. Dakody Hall was a passenger in a Chevrolet Silverado heading down the road.

A semi-truck failed to yield the right-of-way to the Silverado and hit the vehicle. Paramedics were called to the scene of the collision in order to help the victims.

Unfortunately, Dakody Hall died due to the severe nature of his injuries. Police officers issued a citation for the truck driver involved in the collision.

Liability For Angelina County Semi-Truck Accidents

Thousands of people are killed every year in accidents involving commercial trucks. According to the FMCSA, “There were 13.49 fatal large truck crashes per million people in the United States in 2020, a 27-percent increase from 10.6 in 2010. In 2020, on average, there were 1.12 fatalities in fatal crashes involving large trucks. In 90 percent of those crashes, there was only one fatality.” There are many steps that cities can take in order to help prevent truck accidents.

  • Signs should clearly indicate that certain roads are not open for commercial vehicles.
  • Intersections with a high number of collisions should be studied.
  • Traffic calming measures should be implemented on roads with a history of speeding drivers.

Semi-truck drivers must undergo specialized training and must do everything in their power to operate their vehicle safely. Many accidents are due to truck drivers that were not properly scanning the road ahead of them. Pursuant to Texas Transportation Code Sec. 545.103, the driver of any motor vehicle intending to turn left must first yield the right-of-way to all drivers traveling from the opposite direction that are close enough so as to pose a hazard. When a truck driver fails to yield the right-of-way to another driver, this could form the basis of a negligence claim.

Depending on the facts of any case, the company that a truck driver worked for could be held at fault for a collision. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a truck driver may have been delivering packages when they were involved in a collision. Victims of semi-truck accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Lacerations
  • PTSD
  • Organ damage

The family of any person that is killed due to the negligence of a truck driver may have legal recourse through a civil claim. Damages in a civil claim can help cover many of the costs that often come with the sudden loss of a loved one. In order to win any civil claim plaintiffs will have to demonstrate negligence. This is one of the reasons that it is so important that all evidence is properly preserved after a crash.
