Liability For Hawthorne Bicycle Accidents
Bicyclists are uniquely vulnerable in car accidents. They are more likely to be overlooked and lack the protection of enclosed vehicles. According to the Centers for Disease Control, “Bicycle trips make up only 1% of all trips in the United States. However, bicyclists account for over 2% of people who die in a crash involving a motor vehicle on our nation’s roads.” There are a number of steps that drivers should take to avoid collisions.
- Drivers should check their blind spots before making turns.
- Drivers should slow down in areas with heavy pedestrian traffic.
- Drivers should continuously scan the road ahead of them.
Under Texas law, all drivers are supposed to exercise due care to avoid hitting any bicyclist or pedestrian. Drivers should be particularly cautious around children or any confused or intoxicated person. If a driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim.
Pickup trucks are often used for commercial purposes. If the driver of a pickup truck was working at the time of a collision, their employer could be held at fault. For example, a pickup truck driver may have been transporting materials to a construction site when they crashed. Victims of bicycle accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Organ damage
Many accident victims may not realize the full extent of their injuries for some time after a collision. Even after a victim’s physical injuries have healed, many accident victims are left with long-term PTSD. Any person that is injured in a Hawthorne car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover the cost of a person’s injuries following an accident.
