Liability For Houston Bicycle Accidents
Far too many bicyclists are seriously injured or killed in car accidents every year. According to the Centers for Disease Control, “Bicycle trips make up only 1% of all trips in the United States. However, bicyclists account for over 2% of people who die in a crash involving a motor vehicle on our nation’s roads.” Drivers should take several steps to avoid hitting bicyclists.
- All drivers should slow down before making turns.
- Drivers should continuously scan the road ahead of them.
- Drivers should abstain from alcohol and other intoxicating substances.
The vast majority of bicyclists are preventable and involve some amount of human error. Pursuant to Texas Transportation Code 434.062, the driver of a motor vehicle shall not follow another vehicle closer than would be reasonable and prudent given the prevailing conditions of the roadway. If the driver of a delivery van was working at the time of a collision, their employer could be held at fault. Companies are typically liable for the wrongful actions of their employees. Victims of bicycle accidents tend to suffer very serious and horrific injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
- Death
It is extremely important that all evidence is properly preserved after any collision. Evidence is what will ultimately be used to determine liability. The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine the unique facts of your case and let you know what your legal options are.
