Liability In Gonzales Semi-Truck Accidents

Thousands of people are killed or seriously injured every year in semi-truck accidents. According to the National Safety Council, “A total of 4,965 people died in large-truck crashes in 2020. The number of deaths decreased 1% from 2019 but is still up 31% since 2011. The majority of deaths in large-truck crashes are occupants of other vehicles (71%).” There are many factors that could potentially contribute to a semi-truck accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver fatigue

All semi-truck drivers will need to get a commercial license and are held to a high standard in terms of safety. Many accidents are caused by truck drivers that make dangerous left turns. Pursuant to Texas Transportation Code Sec. 545.103, the driver of any motor vehicle intending to turn left must first yield the right-of-way to all drivers traveling from the opposite direction that are close enough so as to pose a hazard. If a truck driver makes an abrupt turn in front of another driver, this could form the basis of a negligence claim.

If a truck driver was working at the time of a collision, the company that they worked for could be held at fault. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a truck driver may have been delivering packages when they were involved in a crash. There are a number of steps that should be taken after any semi-truck accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • The truck’s event data recorder (EDR) should be examined.
  • A thorough, independent investigation should be conducted.

The family of any person killed in a truck accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral expenses. In order to win any civil claim, plaintiffs will have to demonstrate negligence. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
