Liability For San Francisco Pedestrian Accidents
Despite an ongoing pedestrian safety campaign by city officials, San Francisco can still be a a very dangerous place for pedestrians. According to Walk San Francisco, “In 2021, of the 13 pedestrians killed, 6 were seniors. Citywide, around 30 people are killed and more than 500 severely injured each year on San Francisco streets.” There are a number of steps that drivers should take to help prevent pedestrian collisions.
- Drivers should check their blind spots before turning.
- Drivers should slow down in areas with heavy pedestrian traffic.
- Drivers should be well rested before heading out onto the road.
All drivers have a legal obligation to exercise all due care and vigilance necessary to keep pedestrians safe. According to California Vehicle Code 21950, the driver of any vehicle must yield the right of way to any pedestrian that is crossing in a lawfully marked crosswalk. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Amputations
- PTSD
The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. In order to win any civil claim, plaintiffs will need to demonstrate negligence.
