Even if a pedestrian is outside of a marked crosswalk, every driver must use caution and slow down to avoid hitting them. If a driver failed to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. There are a number of steps that should be taken after a pedestrian accident.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A thorough investigation should be conducted.
The family of any person that died in a car accident may have legal recourse through a wrongful death claim. A civil claim can help cover many of the expenses that come with the loss of a loved one.
