Depending on the facts of any case, a jail could be liable if any inmate dies in their care. Inmates have a constitutional right to receive reasonably adequate healthcare. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a negligence claim. For example, correctional officers may have failed to give an inmate proper care prior to them experiencing a medical emergency. There are a number of steps that should be taken after any inmate death.
- Eye witnesses should be interviewed.
- Surveillance footage should be reviewed.
- Medical records should be preserved.
- A thorough, independent investigation should be conducted.
The family of any inmate that died in custody may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, it is common for jails to deny all responsibility if an inmate dies in their care. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
