Liability For San Diego Motorcycle Accidents
Far too many motorcyclists are killed in San Diego County every year. According to the San Diego Reader, “In 2016, the San Diego Medical Examiner reported 63 motorcyclists died […]. That was a 33 percent increase from 47 motorcycle deaths in 2015.” There are many different steps that drivers should take to avoid hitting motorcyclists.
- Drivers should check their blind spots before changing lanes.
- Drivers must observe all traffic regulations.
- Drivers should slow down during periods of reduced visibility.
The vast majority of car accidents involve some amount of driver error. Many drivers end up hitting motorcyclists after they fail to observe stop signs. Pursuant to California Vehicle Code 22450, the driver of any vehicle approaching a stop sign shall stop at the limit line before entering the crosswalk. There is a rebuttable presumption of negligence on the part of any person that goes into the path of a motorcyclist.
Depending on the facts of any case, liability for any collision could extend beyond any driver. A city or municipality could be liable for a collision if it was caused by a dangerous condition in the roadway. According to California Government Code 835, a public entity is liable for an accident caused by a dangerous condition with a roadway provided that the dangerous condition created a reasonably foreseeable risk of injury. Victims of motorcycle accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Beneficiaries in a civil claim will typically include a victim’s next of kin such as their spouse or children. It is extremely important that evidence is properly preserved after any collision. Evidence is what will ultimately reveal liability for a crash.
