They were transported to the hospital to receive treatment. A full investigation remains ongoing at this time.

Liability In Berkeley Car Accidents

Bicyclists are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the CDC, “The costs of bicycle injuries and deaths from crashes typically exceed $23 billion in the United States each year. These costs include spending on health care and lost work productivity, as well as estimated costs for lost quality of life and lives lost.” There are a number of steps that cities can take to protect bicyclist.

  • Roadways and intersections should be well illuminated.
  • Traffic signs should be unobstructed by foliage.
  • Protected bicycle lanes can protect bicyclists from errant vehicles.

All drivers have a legal obligation to exercise due care to avoid hitting bicyclists. Many collisions are due to drivers that make dangerous left turns and fail to check their blind spots. If a driver failed to reduce their speed and hit a bicyclist, this could form the basis of a negligence claim. A city could potentially be liable for a bicycle collision, if it was due to a dangerous condition on public property. There are a number of steps that should be taken after any bicycle accident.

  • Photos of the accident site should be taken.
  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • A thorough, independent investigation should be conducted.

Any person that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Many accident victims may not realize the full extent of their injuries for several weeks or months after a collision. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
