Liability For Pacific Beach Motorcycle Accidents
Thousands of pedestrians are killed or seriously injured every year in the United States. According to the Centers for Disease Control, “Higher vehicle speeds increase both the likelihood of a pedestrian being struck by a car and the injury severity. Most pedestrian deaths occur in urban areas, on roadway locations away from intersections (where higher speeds might occur), and at night.” Even a small amount of alcohol below the legal limit can seriously impact a person’s ability to drive safely.
- Drivers with a BAC of 0.05% have trouble staying in a single lane.
- Drivers with a BAC of 0.05% have trouble concentrating on the road.
- Drivers with a BAC of 0.05% have trouble paying attention to traffic signs.
It is illegal to operate a motor vehicle under the influence of alcohol or drugs. Pursuant to California Vehicle Code 23152, no driver shall operate a motor vehicle with a blood alcohol concentration (BAC) of 0.04% or higher. If a driver hits a pedestrian while intoxicated, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Many accident victims may not realize the full extent of their injuries for several weeks or months after a collision.
