Liability For Fresno Car Accidents
California has one of the highest instances of hit-and-run collisions in the United States. According to Value Penguin, “The number of Golden State crashes accounted for 17% of the U.S. total, with 2,948 crashes causing 3,056 deaths. Texas and Florida also logged more than 1,000 fatal hit-and-runs (1,965 and 1,739, respectively), with each state’s fatality count rising over the 10 years.” There are a number of factors that could potentially contribute to a hit-and-run collision.
- Speeding
- Distracted driving
- Inclement weather
- Poor road conditions
All drivers have a legal obligation to continuously scan the road ahead of them to avoid collisions. Pursuant to California Vehicle Code 21950, the driver of any vehicle shall exercise all due care and reduce their speed as necessary to safeguard the wellbeing of the pedestrian in the road. If a driver fails to reduce their speed and hits a pedestrian, this could form the basis of a negligence claim.
Depending on the facts of any case, liability for a collision could extend beyond any driver. Vans are often used for commercial purposes. If the driver of a van was working at the time of a collision, their employer could be held responsible for the crash. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties.
- A van may have been used for medical transport.
- A van may have been used for personal transport.
- A van may have been used to deliver packages.
The family of any person that is killed in a collision may have legal recourse through a wrongful death claim. Damages can help cover lost wages, medical bills and pain and suffering. Potential beneficiaries will typically include a victim’s spouse and children. However, it is common for drivers to deny all responsibility for a car accident. A wrongful death attorney can examine all of the unique facts of your case free of cost and let you know what your legal options are.
