Liability In Yucca Valley Pedestrian Accidents

California has one of the highest instances of pedestrian accidents in the United States. According to the California Office of Traffic Safety, around 893 pedestrians were killed on California roadways in 2018 alone. That same year approximately 14,000 pedestrians were injured in collisions. There are a number of steps that drivers should take in order to avoid hitting pedestrians.

  • Drivers should slow down at night and during periods of inclement weather.
  • Drivers should continuously scan the road ahead of them.
  • Drivers should obey all traffic laws.

All drivers have a legal obligation to exercise due care to avoid hitting pedestrians. Many pedestrian collisions are due to drivers that are speeding. Pursuant to California Vehicle Code 22350, the driver of a motor vehicle shall not operate their vehicle at a speed greater than would be safe or reasonable given the prevailing conditions of the roadway. If a driver fails to reduce their speed and hits a pedestrian, this could form the basis of a negligence claim.

Many pickup trucks are used for business purposes such as construction or landscaping. The company that a pickup truck driver worked for could be liable for an accident. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were acting within the course and scope of their job duties. There are a number of steps that should be taken after any pedestrian accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough, independent investigation should be conducted.

When a driver is negligent and kills a pedestrian, they can face civil liability for the crash. The family of any pedestrian that died may be able to seek some measure of justice through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral expenses. Unfortunately, it is common for drivers to deny liability for any collision. This is why it is so important that all evidence is properly preserved after a crash.
