Construction Worker Killed In Chico Cement Truck Explosion Accident

CHICO, CALIFORNIA (October 24, 2022) – A construction worker identified as Jesse Goforth has tragically died in a Chico cement truck explosion accident at a construction site by Boeing Avenue by Hiller Avenue.

Butte County officials say that the accident occurred around 3:50 p.m. on Friday. Jesse Goforth was near a cement truck when he was struck by shrapnel from an explosion.

Firefighters and paramedics were called to the scene of the collision in order to help the victim. Sadly, the construction worker died as a result of his injuries.

The explosion was caused by a clogged pipe in the truck, according to investigators. A full investigation by OSHA remains ongoing at this time.

Please pray for the Goforth’s. Thank you so much.”

Liability For Chico Workplace Explosion Accidents

Explosions are a common hazard in the construction industry. According to the ELCOSH, “NIOSH’s National Traumatic Occupational Fatality (NTOF) database reported 220 deaths due to fire and 354 deaths due to explosion from 1980-1995 in construction, an average of 36 fire and explosion deaths per year. The rates were 0.2 fire deaths and 0.3 explosion deaths per 100,000 construction workers.” There are a number of common causes of workplace explosions.

  • Combustible dust can ignite
  • Gas leaks could lead to an explosion
  • Improperly stored chemicals could mix and cause an explosion.

Depending on the facts of any case, a company or entity separate from a worker’s employer could be liable for a workplace accident. Construction sites are typically made up of a blend of different companies that must work together. A general contractor could be liable for a workplace explosion if they failed to maintain their premises in a reasonably safe condition, as required under California Civil Code 1714. The manufacturer of a dump truck could also be liable for an accident if it was caused by a design defect. There are a number of steps that should be taken after any workplace accident.

  • Eyewitnesses should be interviewed.
  • Medical records should be preserved.
  • Workplace maintenance records should be examined.
  • A thorough investigation should be conducted.

The family of any worker that is killed on the job may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that can come with the sudden loss of a loved one. However, construction companies typically will do everything that they can to deny liability for any workplace accident. This is why it is so important that all evidence is properly preserved after a worker is injured or killed.
