Liability In Jacksonville Car Accidents
Car accidents remain one of the leading causes of injury and death in the United States. According to the IIHS, “There were 35,766 fatal motor vehicle crashes in the United States in 2020 in which 38,824 deaths occurred. This resulted in 11.7 deaths per 100,000 people and 1.34 deaths per 100 million miles traveled. The fatality rate per 100,000 people ranged from 4.9 in Massachusetts to 25.4 in Mississippi.” The vast majority of car accidents are due to human error. There are many factors that could contribute to car accidents.
- Speeding
- Distracted driving
- Inclement weather
- Driver fatigue
All drivers have a legal obligation to exercise due care and take steps to avoid collisions. There are many steps that drivers should take in order to prevent their trailers from swaying. Drivers should always travel at a safe speed. They should avoid any sudden movements. Trailers should not be overloaded. Any load on a trailer should be properly distributed. The trailer should be properly hooked up. If a driver fails to exercise due care while towing a trailer, this could form the basis of a negligence claim.
Depending on the facts of any case, liability for a car accident could extend beyond any driver. Pickup trucks are often used for commercial purposes such as landscaping or construction. If a pickup truck driver was working at the time of a collision, the company that they were working for could be held at fault. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. There are a number of steps that should be taken after any car accident.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A thorough, independent investigation should be conducted.
It can be difficult to know where to begin after any accident. But it is important to remember that accident victims and their families do have rights. The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Unfortunately, drivers will often fight hard to deny any responsibility for a collision. This is why it is so important that all evidence is properly protected and preserved.
