Liability In Sacramento Dump Truck Accidents

Dump trucks can be extremely dangerous for pedestrians and those in passenger vehicles. According to the Engineering News Record, “Dump truck accidents severe enough that the vehicle had to be towed away rose 9%, hitting 8,206 in 2016, the latest year statistics are available.” Federal regulators and industry safety experts have sought to limit the number of collisions by limiting driver fatigue and incorporating safety features into dump trucks. There are many factors that could contribute to dump truck accidents.

  • Dump truck companies make more money as their drivers complete their routes as quickly and efficiently as possible. There is an incentive for dump truck drivers to cut corners in terms of safety.
  • Dump trucks have large blind spots that can obscure the presence of smaller vehicles.
  • Dump trucks have a wide turning radius and are more likely to be involved in side-impact collisions.

Dump truck drivers have a legal responsibility to exercise due care to avoid collisions. Many collisions are due to dump truck drivers that are speeding. Pursuant to California Vehicle Code 22350, no person shall drive a motor vehicle at a speed greater than would be reasonable or prudent given the prevailing conditions of the roadway. There is a rebuttable presumption of negligence on the part of any driver that rear-ends another vehicle in their own lane.

If a truck driver was working at the time of a collision, their employer could be held liable for their actions. Employers are typically held vicariously liable for the negligent actions of their employees – insofar as those workers were operating within the course and scope of their job duties. For example, a dump truck driver may have been transporting materials to some construction site. Victims of dump truck accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Per federal regulations, dump trucks and other large commercial vehicles will typically need to carry between $750,000 – $5,000,00 worth of liability coverage. Any person that is injured in a dump truck accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A dump truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
