Liability In Mountain View Bicycle Accidents

Far too many people are seriously injured every year in bicycle collisions. According to the IIHS, “Each year about 2 percent of motor vehicle crash deaths are bicyclists. Although child bicyclist deaths have declined over the years, deaths among bicyclists age 20 and older have almost quadrupled since 1975.” There are a number of factors that could potentially contribute to a bicycle accident.

  • Inclement weather
  • Distracted driving
  • Driver fatigue
  • Poor road conditions

All drivers have a legal obligation to exercise due care in order to avoid hitting bicyclists. A large number of collisions are due to drivers that are distracted or otherwise driving too fast for the prevailing conditions. If a driver fails to reduce their speed in order to avoid hitting a bicyclist, this could form the basis of a negligence claim. Victims of bicycle accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Any person that is injured in a bicycle accident due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A bicycle accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
