Despite life-saving measures, he was pronounced dead at the scene. A full investigation into the crash remains ongoing at this time.

Liability In Irvine Semi-Truck Accidents

Semi-trucks are involved in a relatively small percentage of all motor vehicle collisions. But they account for over 10% of all motor vehicle fatalities. According to the National Safety Council, “In 2020, 4,842 large trucks were involved in a fatal crash, a 4% decrease from 2019 but still a 33% increase since 2011. The involvement rate per 100 million large-truck miles traveled is down 5% from 2019, but up 18% since 2011.” There are a number of critical events that are likely to proceed a serious truck accident.

  • The truck driver ran out of room in their own lane of travel.
  • The truck driver lost control due to traveling too fast for the prevailing conditions or cargo shift.
  • The truck driver collided with the rear of another vehicle.

Truck drivers, like all commercial drivers, are expected to operate their vehicles with a high degree of vigilance. They must be well rested before the start of their shift. Ideally, they should also plan their route out ahead of time. Many truck accidents occur when truck drivers make abrupt lane changes. Pursuant to California Vehicle Code 22107, no person shall turn a vehicle from a direct course either right or left upon the roadway until such a movement can be made with reasonable safety.

The company that packed a semi-truck could also potentially be held at fault for a collision. Though it may seem odd, many truck accidents involve trucks that are not properly loaded. An improperly loaded truck is inherently less stable and more prone to tipping over. Companies that pack trucks must ensure that their employees are well-trained and know how to do their jobs correctly. But this doesn’t always happen. There are a number of steps that should be taken after any semi-truck accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • The truck’s event data recorder (EDR) should be examined.
  • A thorough, independent investigation should be conducted.

It can be difficult to know where to begin after a serious truck accident. But it is important to know that victims of serious accidents do have rights. The family of any person killed in a truck accident may have legal recourse through a wrongful death claim. Damages can help cover many of the expenses that come with the sudden loss of a loved one. A wrongful death attorney can examine all of the unique facts of your case free of cost and get to the bottom of what caused an accident.
