Liability In Yarnell Car Accidents

Thousands of pedestrians are killed or seriously injured every year in the United States. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” Pedestrian accidents are more likely to occur in the early morning and late evening hours. There are a number of steps that drivers should take in order to help prevent pedestrian accidents.

  • Drivers should check their blind spots before making turns.
  • Drivers should slow down in areas with heavy pedestrian traffic.
  • Drivers should abstain from alcohol and other intoxicating substances.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim.  A police department could also be liable for a collision if one of their officers hit a pedestrian. However, the officer must have been working within the course and scope of their job duties. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries
  • Death

The family of any person that is killed due to the negligence of a police officer may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that can come with the sudden loss of a love one. Sadly, police departments will often fight extremely hard to deny liability for any collision involving their officer. This is why it is so crucial that all evidence is preserved after a crash.
